    Terms of Service

    Effective Date: 28 May 2026

    These Terms of Service (“Terms”) govern the use of communication channels, operational coordination, and transport services provided by Hoong Chan Trading& Transport Sdn. Bhd. (HCT, “Company”, “we”, “our”, or “us”), including but not limited to WhatsApp Business, telephone communication, email correspondence, and related operational systems.

    By communicating with HCT, engaging our services, or using our communication platforms, you acknowledge that you have read, understood, and agreed to these Terms.

    1. Services

    HCT provides transport and logistics related services, including but not limited to:

    • Domestic lorry transportation
    • Delivery coordination
    • Shipment arrangement
    • Operational transport communication
    • Route and scheduling coordination
    • Shipment status updates
    • Customer service communication
    • Transport documentation coordination

    The scope of services may vary depending on operational requirements, vehicle availability, road conditions, and customer arrangements.

    2. Communication & Operational Coordination

    Customers, suppliers, consignees, subcontractors, drivers, and business partners may communicate with HCT through WhatsApp Business, telephone, email, or other approved communication channels for operational and business purposes.

    Users are responsible for ensuring that all information provided to HCT is accurate, complete, and up-to-date.

    Operational instructions, delivery information, addresses, contact details, scheduling requests, and shipment-related information provided by users shall be deemed accurate unless otherwise notified.

    HCT may rely on such information for operational execution and shall not be responsible for losses arising from inaccurate or incomplete information supplied by users or third parties.

    HCT reserves the right to impose additional operational charges, waiting time charges, standby charges, or related costs arising from excessive delays at collection or delivery locations beyond the allocated operational time frame.

    3. Service Availability

    HCT will use reasonable commercial efforts to provide timely transport coordination, communication, and operational support.

    However, users acknowledge that transport operations may be affected by circumstances beyond HCT’s reasonable control, including but not limited to:

    • Traffic congestion
    • Weather conditions
    • Vehicle breakdowns
    • Road closures or accidents
    • Government restrictions or enforcement activities
    • Labour shortages
    • Force majeure events
    • Internet, network, or communication system interruptions
    • GPS or tracking system downtime
    • Third-party service disruptions

    Estimated delivery times, schedules, or operational updates provided through communication channels are estimates only and shall not constitute guaranteed delivery commitments unless expressly agreed in writing.

    4. Digital Communication Disclaimer

    Users acknowledge that communication through WhatsApp Business, email, mobile messaging, or other digital platforms may not always be secure, uninterrupted, error-free, or immediately delivered.

    HCT shall not be liable for delays, missed communications, data transmission failures, platform outages, or technical interruptions arising from third-party communication platforms or network providers.

    Users are encouraged to verify critical operational instructions through direct communication where necessary.

    5. Limitation of Liability

    To the fullest extent permitted under applicable laws, HCT shall not be liable for:

    • Indirect losses
    • Consequential losses
    • Loss of profits
    • Business interruption
    • Delay-related losses
    • Loss arising from communication failures
    • Loss arising from inaccurate information supplied by users or third parties
    • Losses caused by events beyond reasonable operational control

    Where applicable, HCT’s services may be subject to customer agreements, subcontractor arrangements, operational transport conditions, or industry-standard transport liability limitations recognized within the transportation and logistics industry in Malaysia.

    HCT’s liability, where applicable, shall be limited to the extent permitted under such agreements and applicable laws.

    Nothing in these Terms shall exclude liability where such exclusion is prohibited by law.

    6. Use of Subcontractors & Third-Party Providers

    HCT reserves the right to utilize subcontractors, third-party transporters, digital service providers, cloud platforms, software systems, GPS systems, and operational partners where reasonably necessary for transport execution and business operations.

    Users acknowledge that certain operational data and communication may be shared with such parties for legitimate operational purposes.

    7. Proper Use of Communication Channels

    Users shall not:

    • Send unlawful, abusive, threatening, defamatory, or fraudulent content
    • Misuse HCT communication channels
    • Impersonate other individuals or entities
    • Distribute malicious software, spam, or harmful content
    • Interfere with operational communication systems
    • Use communication platforms for unauthorized commercial purposes

    Users shall ensure that goods tendered for transport comply with applicable laws and regulations.

    HCT reserves the right to reject or refuse any shipment that:

    • violates applicable laws or regulations;
    • may create safety, operational, or legal risks; or
    • involves prohibited or unlawful items.

    Users shall remain responsible for ensuring that shipments comply with applicable Malaysian laws and transport regulations.

    HCT reserves the right to suspend, restrict, or discontinue communication with users who misuse the platform or violate these Terms.

    8. Confidentiality

    Operational, pricing, shipment, and business-related information exchanged during communication should be treated with reasonable confidentiality unless:

    • disclosure is required by law;
    • disclosure is required for operational execution;
    • the information is already publicly available; or
    • disclosure is reasonably necessary for transport coordination.

    9. Personal Data Protection

    The collection, processing, storage, and disclosure of personal data by HCT shall be governed by HCT’s Personal Data Protection Notice & Privacy Policy in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.

    Users acknowledge that operational communication and transport coordination may require the processing and sharing of personal data for service execution purposes.

    10. Record Retention

    HCT reserves the right to retain communication records, transport documentation, digital logs, operational records, and related business records for operational, legal, audit, compliance, security, and dispute resolution purposes.

    11. Amendments

    HCT reserves the right to amend, update, or revise these Terms at any time without prior notice.

    The latest version shall prevail and may be made available through HCT’s official communication channels or website.

    12. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of Malaysia.

    Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Malaysia.

    14. Language

    These Terms of Service may be made available in both English and Bahasa Malaysia.

    In the event of any inconsistency between language versions, HCT may adopt English version shall prevail.

    This Personal Data Protection Notice & Privacy Policy (“Notice”) is issued in accordance with the Personal Data Protection Act 2010 (“PDPA”) of Malaysia.

    By engaging with HCT, communicating with us, or providing personal data to us directly or indirectly, you acknowledge and consent to the processing of your personal data in accordance with this Notice.

    2. Purpose of Processing Personal Data

    HCT may process personal data for purposes including but not limited to:

    • Delivery and shipment management

    3. Consent & Operational Data Handling

    Personal data processed by HCT may be obtained directly from the data subject or indirectly through customers, suppliers, consignees, subcontractors, transport coordinators, or other operational parties involved in logistics activities.

    Where personal data is provided to HCT by a third party, such party is deemed to have obtained the necessary consent from the relevant data subject for disclosure and processing by HCT.

    By communicating with HCT through WhatsApp Business or other communication channels, users acknowledge and consent to receiving operational and service-related communications, including but not limited to:

    • Delivery coordination
    • Shipment updates
    • Scheduling notifications
    • Operational instructions
    • Documentation requests
    • Customer support communication

    Please note that certain operational communications may be necessary for transport execution, shipment coordination, safety verification, legal compliance, or delivery completion purposes.

    4. Disclosure & Sharing of Personal Data

    HCT may disclose or share personal data where reasonably necessary for operational, legal, or business purposes, including with:

    • Customers and consignees
    • Suppliers and vendors
    • Subcontractors and third-party transporters
    • Drivers and fleet operators
    • Warehouses and logistics partners
    • Cloud storage or digital system providers
    • IT service providers and software platforms
    • Government authorities and regulatory bodies where required by law

    HCT may utilize digital systems, cloud-based platforms, automated communication systems, GPS monitoring systems, and operational databases for logistics coordination and business management purposes.

    Reasonable efforts will be taken to ensure that third parties handling personal data maintain appropriate confidentiality and security measures.

    5. Data Security

    HCT takes reasonable practical and administrative measures to protect personal data against unauthorized access, misuse, modification, disclosure, or destruction.

    However, users acknowledge that no method of electronic transmission or storage is completely secure, and HCT cannot guarantee absolute security.

    6. Data Retention

    Personal data may be retained for as long as necessary for:
